To The Sheriff of said County Greeting ~~

Whereas at the June Term of this Court 1841 John Roberts obtained letters
of administration upon the estate of James Russell, deceased and has not
accounted to this Court in full or in part up to the present time for his
transactions of the business of said estate ~~~ Therefore you are hereby
commanded to summon the said John Roberts, administrator aforesaid, to be
and appear at the next Term of the Hon. Probate Court to be held in at the
Court House in the Town of Lafayette on the last Monday of this Inst. and
account for his proceedings in relation to said estate as he is required so
to do by law. ~~~~ Herein fail not and have you then and there this writ
certifying thereon how you have executed the same ~~~
Given under my hand & Seal of office this 15th day of Nov. A. D. 1842.

John Roberts, Administrator of James Russell, Deceased comes before the Court
and for report saith that twelve hundred and eighty acres of land is all the
property which has come to his hand, that he has frequently tried to get the
appraisers together to have the same appraised but has hereunto failed so to
do, Since one of the appraisers has died {Thomas Brumley} in his place your
reporter recommends the appointment of James Davis, and your reporter further
saith that he did not intend any contempt to Law in not reporting as required
by Law that he was confined by Sickness and all together unable so to do ~
for all of which he prays further time to enable him to be ready for a final
settlement and partition of said Land ~ And further this reporter saith that
it will be necessary to sell three hundred and twenty acres of this Land to
pay demands against this Estate. Therefore he prays a decree of your Honor’s
Court to that effect ~ and as in duty bound will or may.
