Now on this day came on to be heard the above entitled cause and the plaintiff appearing by
attorney and announced ready for trial, and it appearing to the Court that the defendants the children of
John M. Kuykendall, deceased all minors, to wit ~ Eudora Eliza, Cynthia Anne, Leonie, John M.
and James Kuykendall had been duly ordered and that the Court had appointed the Mother of said minors
~ Viz. ~ Sarah Kuykendall Special Guardian of said minors and each of them to defend this suit and said
special guardian had accepted and qualified under said appointment but makes default and failed to appear, answer and
defend.
It is therefore ordered that a writ of Seizure be and the same is hereby awarded ~ and upon said award
now comes a good and lawful Jury to wit ~ Henry Shaper and eleven others who being duly tried, impaneled
& sworn ~ and who after hearing the pleadings, evidence and arguments of consul and charges of the Court retired to
consider of this verdict ~ and thereupon returned into Court the following verdict ~ to wit ~ We the jury find in favor
of the plaintiff against the defendants for the Land described in the petition ~ to wit ~ one League lying in Medina County
granted by the Republic of Texas to Abraham L. Kuykendall by Letters Patent ~ No. 717 ~ Vol. 2
dated the 27th day of June 1845.
It is therefore considered, ordered, decreed and adjudged by the Court that all right title and interest of
said minors and each of them in and to One League of land lying in Medina County granted by the Republic of Texas
to Abraham L. Kuykendall by Letters of Patent ~ No. 717, Vol. 2, dated June 27th 1845 be and the same
is hereby divested out of said minors and each of them and is vested in the plaintiff Jesse B. Kuykendall
and said League of land is more particularly described as follows ~
In Medina County ~ Beginning at the North East corner of survey No. 20 in
Section 3 of one half league and half labor on the Hondo Creek Survey
for William Bryan ~ Thence North five thousand varas to a stake from which
a Mesquite bears south 20° West 9 varas and another bears south 60° East
72 varas ~ Thence West Twenty five hundred varas to the Hondo Creek
five thousand varas to a stake from which a mesquite bears south 32° East
18 varas and another bears south 71° West 30 varas. Thence south four hundred
varas the said Creek at five thousand varas a stake from which a Mesquite bears
south 27° East19 1/2 varas and another bears south 88° West 4 1/2 varas ~
Thence East at thirteen hundred seventy four and one half varas the North West
corner of the aforesaid survey ~ No. 20, Section No. 3 at five thousand varas
the place of beginning.
And it is further ordered by the Court that the defendants & officers of this Court have executed
against the plaintiff for all costs of this proceeding.
