The Undersigned, a part of the Commissioners appointed by your Honor to partition
and distribute between the heirs of Jno. Roberts Sn'r, dec'd & M. H. Wright certain
Lands in Hunt County in obedience to the Writ of Partition to us directed by the
Clerk of the District Court of said County dated, on the 9th day of Feb'y 1869,
Concerned to set apart to M. H. Wright Lot No. 1 as shown upon accompanying plat
and bounded as follows ~ to wit:
Beginning at the N. W. corner of the original survey of 25 Labors mentioned in said
Writ and runs South 2500 vrs to a ~stake. Thence East 2500 vrs to a stake. Thence
North 2400 varas to a stake. Thence West 2500 varas to the beginning, containing 1151 acres.
We also set apart to Jno. Roberts Jr. Lot No. 10 as shown upon said plat and bounded
as follows ~ To Wit: ~
Beginning at the N. E. corner of said 25 Labors or League survey and Runs East 107 varas
to the S. E. corner of the Labor survey mentioned in said Writ. Thence North 527 varas
to the N. E. corner of said Labor. Thence West 636 vrs to a stake. Thence South
1600 vrs.~ to a stake. Thence East 529 vrs. to a stake. Thence North 1073 vrs. to the
beginning, Containing One Hundred and Sixty Acres.
Your Commissioners then proceeded to partition the remainder of said League and Labor
of Land into eight different Lots numbered. on said Plat Nos. 2. 3. 4. 5. 6. 7. 8. and 10.
divided into Lots corresponding in numbers, the said division being made as near
equal in quantity, and quality as was practicable for said Commissioners under the
circumstances, and having divided said Land, as aforesaid, Your commissioners proceeded
to partition the same by casting Lots, when Lucinda Roberts drew Lot No. 2.
Beginning at the S. W. corner of the Original League survey and runs North 2500 vrs
to the S. W. corner of No. l. Thence East 942 vrs. to a stake. Thence South 2500 vrs
to a stake in the S. bd'y of said original survey. Thence West 942 vrs to the beginning,
Containing 417 1/4 acres.
William Roberts drew Lot No. 3. in two surveys the 1st:
Beginning 942 vrs. East of the S. W. corner of the original survey being S. E. corner
of Lot No. 2. and runs East 757 vrs. to a stake. Thence North West 257 vrs. to a stake.
Thence North West 757 vrs. to a stake in the N. E. corner of Lot No. 2. Thence South
2500 vrs to the beginning ~ prairie. ~ Containing 335 1/4 acres.
The other No. 3. being timbered.
Beginning 2500 vrs. East of the N. W. corner of the Original Survey, it being the N. E.
corner of Lot No. 1. & runs east with North boundary of the Original survey 431 varas to
a stake. Thence South 1073 vrs. to a stake. Thence West 431 vrs to a stake in the East
boundary Line of No. 1. Thence North 1073 varas to the beginning. Containing 82 acres,
making Lot No. 3. in all 417 1/4 acres.
Reddin Roberts drew Lot no. 4. Being 2 Tracts. 1 Timbered & 1 Prairie.
The Prairie tract of 335 1/4 acres.
Beginning 1699 vrs. E. of the S. W. corner of the original survey a stake the
S. E. corner of Lot No 3 & runs North 2500 vrs to a stake. the N. E. corner of Lot 3:
on the south boundary line of Lot No. 1. Thence East 757 vrs. to a stake. Thence South
2500 vrs. to a stake. Thence West 757 vrs. to the beginning. ~
The Timbered Tract being 82 acres.
Beginning at the S. W. corner of the Labor on the N. bdy line of the League
survey & runs North 287 varas to a stake. Thence east 208 varas to a stake. Thence South
1363 varas to a stake. Thence West 376 v'rs. to a stake. Thence North 1073 v'rs to the
Beginning, both Lots containing in all 417 1/4 acres. ~~
Dorcas Roberts drew Lot No. 5 being in 2 surveys, One Timber and One Prairie.

Jemima Roberts drew Lot No. 9. Beginning 1073 v'rs S. of the N. E. corner of the Original
League Survey & runs. Thence South 942 v'rs to a stake the N. E. corner of Lot No. 8.
Thence West 2400 varas to a stake the N. W. corner of Lot No 8. on the East b'dy line
No. 1. Thence North 942 varas to a stake the south West corner of Lot No. 3. Thence East
with the South boundary line of Lots Nos. 3. 4. 5. 6. 7. 8. and 10, Containing 417 1/4 Acres.

It is further order, adjudged & decreed that Jno Roberts Jr. do have and recover of &
from the parties, Plaintiffs & Defendants Lot No. 10. as set forth & bounded in said
Report & that all right, title & interest of said heirs in & to Lot NO. 10. be & the same
is hereby divested out of said heirs & vested in said John Roberts Jr.
It is further ordered, adjudged & decreed the the Title in and to the respective Lots
of Land, as set forth in said Report be and the same is hereby vested in each of the
persons or their Heirs as therein specified from all the claim & right of each of the
other parties Plaintiffs & Defendants, according to the Numbers, Metes & Bounds in said
Report specified.
It is further ordered, adjudged & decreed by the Court, that the officers of this Court
do have & recover of & from the said parties Plaintiffs & defendants, and the said
Intervenor M. H. Wright all costs of this Partition that is against each or the heirs of
each the pro-rata of said costs in proportion to the amount of Land herein set apart, and
that the following sums be allowed to said Commissioners ~ vis:
To A. Cameron six ($5.00) dollars. To James Hlue Five ($5.00) dollars.
To John Mason Three ($3.00) dollars for their services as Commissioners, for all of which
costs execution may issue in the name of the officers of the Court against them.
This day came Dan'l Uptergrove and presented in open Court his claim for services as
Guardian Ad. Litum for Jemima Farmer Jr., the Minor one of the Defendants herein,
and the said claim being fully examined by the Court & it appearing that the said
Dan'l Uptergrove has been regularly appointed as such Guardian by an Order of this
Court, and that he has rendered service in this cause for said minor, it is order that
said Uptergrove be allowed the sum of Twenty-five ($25.00) to be taken of the share
belonging to the Mother of said minor Jemima Farmer.
I A. D. Robey do hereby certify that the above and foregoing instrument of writing is
a true & correct copy of a Judgement in my office on the Record of the District Court
of Hunt County.
