& As touching such worldly Estate, wherewith it hath pleased God
to bless me thereof I give, sacrifice & dispose of the same in the
following manner & form ~
I give and bequeath to my well beloved Son John Turner a certain
lot of land lying & being in the township of Duxborough in the
County aforesd and is the hundred and fourth lot in number in the
upland belonging to the second division of the Common belonging
to the Towns of Duxborough & Pembroke & was layd out in the year
of our Lord 1713. I also give to my sd son John a certain piece of
marsh & marsh land lying within the township of Pembroke aforesd
and is bounded on the west side with the north River. Sd marsh is
bounded on the East by the marsh land of Joseph Stockbridge.
I give to my sd son John Turner a piece of marsh & marsh land lying
on the Easterly side of sd River and is bounded on the westerly by sd
River on the northeast by a certain ditch which is the bounds between
the marsh of John Hood bounded on the East by a ditch which is the
bounds of the marsh of Abrams Booth upon the south by a Ditch which
is the bounds between the marsh of Capt. Francis Barker. I also give
to my sd son John Turner the farm whereon Jonas Duffie is bounded
on the Southwest side by the lands of Robert Barker on the northeast
side of the land of sd Robert Barker paying into my Legacy to my three
daughters the sum of forty pounds that is to say to my daughters Mary,
Hannah, Rebekah when they shall come to or arrive at the full age of
Eighteen years but if it should so happen that if either of my sd daughters
should depart this life before they arrive at the age of Eighteen then my
mind & will is that the Legacy aforesd shall be equally divided among the
daughters then surviving and if should so happen that the aforesd three
daughters should depart their life before they shall arrive at the full age
of Eighteen years then my will is that one half of all the aforesd Legacies
given to my well beloved son Joshua & the other half of the sd defined
Legacies I give to my son John.
Item - I give & Bequeath to my Son Joshua Turner a certain two lots
of land lying & being in the township of Pembroke aforesaid one of sd
lots on a forty acre lot which belonged to the first division of Common
land in the township of Duxborough which was laid out in the Year of
our Lord 1710 & is the sixteenth lot in number in the sd Division. The
other lot of land containing about forty one acres & was layd out in the
second Division of the Common belonging to the towns of
Duxborough & Pembroke & was layd out anno Domini 1713 & is
the one hundred & third lot. I also give to my sd son all my mone that is
in a fire lock & sword & the other accouterments there to belonging.
Item - And I give to my well beloved wife Mary whom I likewise
constitute make and ordain my sole Executrix of this my last Will
& Testament. After the paying of all my just debts funeral claims & the
legacy given to my Daughter Rebekah Turner all my memorable
Estate (not before given) untill my son Joshua Turner shall arrive at
lawful age &. Also all the improvement of my farm whereon I now dwell
to be for her support & the bringing up of my children but if it should so
happen that my wife should so cause to alter her condition by marriage,
then my mind & will is that she shall have one third part of the increase
& profits of my sd farm during her naturall life & one-third part of the
measurable estate & the other two third parts of my measurable estate to
be equally divided among my three daughters aforesd (viz):
Mary Turner, Hannah Turner, Rebekah Turner but if it should so
happen that either of my sd daughters should dye before they come to
or gain the full age of eighteen years then my will is that the two thirds
parts of measurable estate shall be equally divided among the survivors
and I do hereby disallow repeal & disanull all & every other former
Testament wills in addition bequeaths & executions by me in any way
before named with & bequeathed ratifying & confirming this & no other
to be my last Will & Testament in witness whereof I have hereunto set
my hand & seal this day & year above written.
